Terms of Use

Recall — AI Memorial End User License Agreement

Effective date: August 2, 2026 Provider: Stefano Anania ("Recall", "we", "us", "our") Contact: support@stefanoanania.com · 525 N Sycamore Ave, Los Angeles, CA 90036, USA

Please read section 3 before you use the app

Recall creates an artificial simulation of a person who has died. It is not that person. It cannot know anything they knew, and it will sometimes say things they never said and would never have said. It is a memorial object, like a photograph or a recording — not a continuation of a life, and not a form of contact with the dead.

Recall is also not therapy, not counselling, and not a crisis service. If you are in danger, contact your local emergency number, or in the United States call or text 988.

1. Agreement

These Terms are a binding contract between you and Stefano Anania. By ticking the agreement box, signing in, or using Recall, you accept them. If you do not accept them, do not use Recall.

Our Privacy Policy, AI & Wellbeing Disclaimer, and Voice & Biometric Notice are part of these Terms.

2. Eligibility

You must be 18 or older and legally able to enter a contract. Recall is not for children, and grief material combined with a synthetic voice of a dead relative is not appropriate for minors. By using Recall you confirm you meet this requirement.

3. What Recall is, and what it is not

Recall is an AI memorial tool. It generates text and speech using large language models and synthetic voice technology, based on details you provide.

You acknowledge and agree that:

Use with care. Interacting with a simulation of someone you have lost can intensify grief, delay adjustment, or cause distress — for some people, considerably. If you are finding it harmful, stop using it, and please talk to a real person. We list bereavement support resources inside the app.

4. Your account

Recall uses Sign in with Apple. Your name and email address are stored on your device only; our servers know you by an anonymous identifier. You are responsible for the security of your device, and for anything done through the app on it.

You may delete your account and everything in it at any time from Profile → Delete Account & Data. Deleting the app also deletes everything on the device. Deletion is permanent and we cannot recover your data — we do not have a copy of it.

5. Voice cloning: your responsibility

This is the most legally significant thing you do in Recall, so it is set out plainly.

Before uploading a voice sample you must confirm that you are the legal next of kin of the deceased, or otherwise hold explicit legal authority to use their voice. That confirmation is a condition of the upload and is enforced on our servers.

You represent and warrant that, for every voice sample you upload:

You must not use Recall to clone the voice of a living person; to impersonate anyone; to create audio intended to deceive; to produce content that defames, harasses, or threatens; to bypass identity verification anywhere; or for any unlawful purpose. Voice cloning without authorisation may violate right-of-publicity, biometric privacy, fraud, and in some places criminal law.

We may remove a voice or terminate your access if we have reason to believe a voice was uploaded without authority — including on the report of a family member of the deceased.

You indemnify us for claims arising from a voice you uploaded without the rights to use it, as set out in section 12.

6. Your content

Everything you put into Recall — profiles, memories, photos, messages, voice samples — remains yours. We claim no ownership.

You grant us only the narrowest licence needed to run the app: to store your content on your device, and to transmit and process it (including via the AI providers named in the Privacy Policy) for the sole purpose of generating the conversation you asked for. That licence ends when you delete the content.

We do not use your content to train AI models, ours or anyone else's, and our provider terms prohibit them from doing so.

You must not upload content that is illegal, that infringes someone else's rights, or that you do not have the right to provide.

7. Acceptable use

Do not: reverse engineer, decompile, or tamper with the app or its network traffic; attempt to obtain our API keys or extract our prompts; automate or script access; interfere with the balance or entitlement system; use the app to generate content that is illegal or that harms others; resell or redistribute access.

8. Purchases, minutes, and refunds

9. Availability

We provide Recall as it is, and we may change, suspend, or discontinue any part of it. The app depends on third-party AI services; if they are unavailable, degraded, or discontinued, parts of Recall will not work. If we discontinue Recall, your on-device data remains on your device — it does not live on our servers, so it does not disappear when we do.

We aim to give reasonable notice of a discontinuation and, where a balance you paid for becomes unusable because of it, to provide a remedy. Consumables already consumed are not refundable.

10. Disclaimer of warranties

To the fullest extent permitted by law, Recall is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment.

We specifically do not warrant that the persona will be accurate, faithful to the person it depicts, emotionally appropriate, or helpful; that the safety detection will identify distress; that the app will be uninterrupted or error-free; or that any voice will sound like the person it was cloned from.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here excludes liability that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent permitted by law:

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. If you are a consumer in the EU, UK, or another jurisdiction with non-waivable consumer protections, those protections apply and take precedence over this section to the extent of any conflict.

12. Indemnity

You will indemnify and hold harmless Stefano Anania, its officers and contractors, from any claim, loss, liability, or expense (including reasonable legal fees) arising from: your breach of these Terms; content you uploaded; and in particular any claim by a family member, estate, heir, or other person concerning a voice, likeness, image, or personal detail you provided without the right to do so.

13. Termination

You may stop using Recall at any time and delete your account in the app. We may suspend or terminate your access if you breach these Terms, if we believe a voice was uploaded without authority, or if required by law. Sections 5, 6, 10, 11, 12, 14, and 18–21 survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules.

If you are in the United States: you and we agree that any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Los Angeles County, California or by videoconference at your election. You and we each waive the right to a jury trial and the right to participate in a class action. Either party may bring an individual claim in small claims court instead. You may opt out of this arbitration agreement by emailing support@stefanoanania.com within 30 days of first accepting these Terms; opting out does not affect any other part of these Terms.

If you are a consumer in the EU or UK: this section does not deprive you of the protection of the mandatory law of your country of residence, or of the right to bring proceedings in your local courts. EU consumers may also use the European Commission's Online Dispute Resolution platform.

15. Changes to these Terms

We may update these Terms. For material changes we will notify you in the app before they take effect, and continuing to use Recall after that constitutes acceptance. If you do not accept a change, stop using Recall and delete your account.

16. General

If any provision is unenforceable, the rest stands. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger or sale of assets, subject to the Privacy Policy. These Terms, with the documents they incorporate, are the entire agreement between us.
